Peter Nyakweba was charged for allegedly on 21st January, 2018 at Nyankongo Village for unlawfully defiling the minor at their home.
In the first account the accused was charged with and indecency for having carnal knowledge with the minor contrary to the sexual offence act.
According to a police report, and a medical examination from the Kisii Teaching and Referral Hospital filed at the court, Nyakweba is believed to have committed the offence when the mother of the minor was watching TV with the wife of the accused.
“We were watching TV my daughter came and rushed to the toilet, I followed her, I found her standing beside the toilet.
I asked her what was happening, it was until I removed her clothes forcefully when I found out what had happened to her before we and other neighbor’s reported the matter to the police.

The minor however said that it was not the first time, the accused had been doing that to her and warn her not to reveal the information to the parents.
The accused pleaded not guilty before principal Magistrate Symphy Makila. The Mentioning of the case will be on 6/2/2018.
