Bobasi member of parliament Innocent Obiri has files an application to be enjoined in an ongoing case stopping the construction of a Rise – Nyagacha road in his constituency

The application was filed n Monday at ogembo law courts before senior Principla Magistrate Danis Mikoyon .

The case was filed by three applicants who are contractors to stop the construction of a road within Bobasi constituency and the court had issued a temporary injunction to restrain the construction of the road.

In his affidavit, Obiri said he wanted to be enjoined in the case since he is the Member of Parliament and be allowed to participate on behalf of his constituent’s since the Road is in the constituency whereby constituents are allowed to participate in the proceedings of the matter.  

By allowing the MP to participate in this matter, will allow the constituent’s voice to be heard. 

On the affidavit, he said the application is made on the interest of justice. 

The applicants who are the contractors appeared in court on monday and upon arrival they found  the application had been mounted and the senior Principal magistrate gave directions.

On the directions the Mikoyan  said the application of enjoinment has come under certificate of urgency. 

Therefore, the said application will be served upon mention 3rd/08/2020 when the court will give orders.
